Yes. It has consistently been advised that when a person seeking records owes an agency money
relating to the reproduction of records in response to a previous request, the agency is not required to
honor the new request until the applicant pays the fees that are owed to the agency.

Subject: FOIL requests

Is a fire district able to delay fulfilling a FOIL request if the person requesting documents has not paid
for the copies of the previous FOIL request? A FOIL request was fulfilled with an amount due of
approximately $17.00 for the copies, and this person has yet to pay and has submitted another FOIL
request. So, can we inform this person we will not fulfil the recent request until the last one is paid in
full? Thank you.
