The staff of the Committee on Open Government is authorized to issue advisory opinions.  The ensuing staff advisory opinion is based solely upon the facts presented in your correspondence.

Enclosed is a copy of FOIL-AO-14836, which speaks directly to the issues that you raise regarding access to assessment roll information, including inventory.  

Perhaps more importantly, please note that the law regarding unwarranted invasion of personal privacy was amended in 2008 and §89(2)(c)(iv) now reads as follows:

“when a record or group of records relates to the right, title or interest in real property, or relates to the inventory, status or characteristics of real property, in which case disclosure and providing copies of such record or group of records shall not be deemed an unwarranted invasion of personal privacy.”

Accordingly, it is our opinion that agencies no longer have authority to require a certification that such a list is not requested for solicitation or fund-raising purposes.
